McCarty v. Pheasant Run , Inc.

Summary of CaseMrs. Dula McCarty brought suit against Pheasant Run Inc. for negligence. In 1981, Mrs. McCarty was attacked by a man in her hotel room, beaten and threatened of rape. Mrs. McCarty ultimately fought off her attacker and he fled. The attacker was never identified nor brought to justice. Although Mrs. McCarty did not sustain serious physical injuries, she claimed the incident caused prolonged emotional distress which led to an early retirement. An investigation revealed that a sliding glass door, which was concealed behind curtains, was manipulated and enabled the attacker to gain entry into her hotel room. Mrs. McCarty made multiple claims of negligence against Pheasant Run Inc., including that they should have had better locking devices on the sliding door; more security personnel; the walkway to her sliding door inaccessible from the ground level; better over all procedures for dealing with non guests; posting signs telling guests to keep their doors locked at all time s. Ultimately, the court did not see it Mrs. McCarty’s way. McCarty argued the judge should have granted her motion for judgment notwithstanding the jury’s verdict for the defendant.McCarty did not request the directed verdict on the issue of Pheasant Runs negligence which is a prerequisite to judgment n.o.v. Many accidents are neither the injurer nor the victims fault and therefore there is no liability. The judge advised Mrs. McCarty that the case was not as one sided as she believed it to be. Additionally, following a jury’s verdict, a judge cannot substitute its judgment when the judgment was reasonable (2). Mrs. McCarty did a poor job in proving that Pheasant Run could have prevented her attack with her advised precautions.Mrs. McCarty did not provide information of what it would cost Pheasant Run to equip the hotel rooms with improved locking systems and whether the system would have been impenetrable. She also failed to advise the jury on the additional s ecurity forces she claimed would have made a difference. In regards to the Mrs. McCarty’s sliding door, it was equipped with a lock and an additional safety chain. The safety chain was fastened but the lock was not used. This case  had evidence of negligence but none of strict liability. There were reasonable precautions in place. Elements of Intentional TortTort law enables citizens to seek reimbursement for loss and or suffering from conduct that would be deemed dangerous or unreasonable of others (3). Tort law is non criminal and is dealt with in our civil judicial system. The categories of Tort Law include intentional tort, negligence and strict liability.An intentional tort case is proved by the plaintiff showing that the defendant intentionally injured him/her (1). In a negligence case, the plaintiff shows that the defendant did not act carefully as the law requires and therefore should be liable for any damages to the plaintiff (1). The strict liability cases occur w hen a plaintiff suffers damages even though the defendant acted carefully and with no intent of harm being done to them (1).During a trial the plaintiff will attempt to prove their case by the presentation of evidence to the trier of fact. The evidence usually includes testimony of persons involved; witnesses as well as physical things such as pictures, documentation/records, recordings etc†¦ How a Defense is TriggeredA common defense is that there was a superseding intervening cause which was the cause of the injury to the plaintiff. The plaintiff must then prove that the injury was a result of the tort committed by the defendant and not due to the progression of the prior cause. Another defense, regarding breach of duty, is that a plaintiff must show they have damage that is legally recognized. The plaintiff cannot claim they have suffered but cannot show damages.Proximate cause refers to the plaintiff being able to show that the damage and or injuries they sustained were a r esult of the tort they are suing for. An example would be the plaintiff’s nose was broke as a result of the defendant flailing his elbow’s amongst the crowd. Features in a Negligence ComplaintScenarios where people are injured as a result of an accident occur more frequently than those where people are injured due to malicious behavior. As a result, the law recognizes a duty to conform to a certain standard of conduct for the protection of others against unreasonable risk of harm. If there is a failure to conform which results in an injury, damage or loss, the injured party has a cause of action for negligence. Additionally, a court will utilize several ways to formulate the negligence standard.One of the more famous is the â€Å"Hand Formula† which determines whether the burden of precaution is less than the magnitude of the accident, if it occurs, multiplied by the probability of occurrence. In a negligence case, there are four elements that must be researched for a plaintiff to recover damages.These elements include: 1) did a defendant owe the plaintiff a duty to act in a certain way 2) did the defendant breach the duty by failing to act as well as the duty required 3) did the defendants conduct cause some harm 4) did the defendants conduct harm the plaintiff (1). If any of these elements are found to not be true then no cause of action in negligence is recognized. It is important to note that it is the responsibility of the plaintiff to prove that the defendant was negligent. There are some differences between negligence and other torts. When establishing negligence, the defendant has a â€Å"reasonable person† standard he/she must abide by.Compared to strict liability, a person has the absolute duty to make safe that which is the subject of the lawsuit (3). Negligence per se is another tort which differs from negligence. Regarding negligence per se, an act performed is shown to be in violation of state law or city ordinance. Ma lpractice is a form of negligence which takes form in a different field. It is coined â€Å"professional negligence† (3). A person is required to act as would a reasonably skilled, prudent, competent, and experienced member of their profession.

How Kulula.com became a big brand in south Africa? In 2001, it was no secret that the national carrier dominated the domestic carrier market. 9/11 was going to change the world forever. South Africa was not a good market for low cost airline because of two main factors: 1) There were no cheap regional airports. 2) Comair Airlines, kulula’s holding company didn’t have resilience to launch a new brand but the folks in kulula were determined and nothing was impossible for them. They refused to believe that it was mission impossible. The first challenge for them was to position the airline correctly. The folks had done their research and found that leisure market would be more interested in low fares and less need for flexibility than business class. This mean that new airline could afford to offer no full service(No-frill) something which never had been available before but having no pre-book seating, free meals at board, or no possibility of rebooking to other airlines, the aim was to keep the cost at minimum and savings passed on to the passenger. It could have been a huge mistake if kulula.com would have concentrated on low cost to position themselves. The smart way to position kulula on promise was to be sustainable and for long term and that is why kulula.com brand positioning of making it accessible and easy was on top. The second challenge this airline faced was on deciding on a name and in the world of branding your brand name can influence or sink. The name  (kulula.com) has taken a brand values such as simplicity, honesty, respect, innovation, safety. So why was Kulula.com a winner? 1. Available as a dotcom 2. Easy to say. 3. Means â€Å"easily† in zulu. 4. Stood for a benfit, rather than a service. The suitable name now decided upon, now was a time to launch the brand. It has tiny budget of 23 million rand as a loan and just one opportunity to get it right. Mary Shelley Essay Do you agree? Frankenstein is one of the great novels of English literature, written in 1816 by a young Mary Shelley. The name Frankenstein is generally associated with the terrifying monster created in the many film adaptations of the book. But did Mary Shelley write only to frighten the reader? Or did she write in order to explore deeper issues of the evolving times she was living in? The basic plot of the novel is typical of a blood-curdling horror story: a mad scientist creates an inhuman monster, which subsequently goes on a murderous rampage, not resting until it has avenged itself. But Shelleys novel uses various other themes throughout the book, asks questions and expresses strong views on the changing balance between science and religion of the early 19th century. Through her monster she explores the themes of isolation, the relationship between God and man, the importance of respecting nature and the dangers of obsession. Shelleys novel has been extremely influential on horror stories since as it is one of the most famous gothic horror novels of all time. It is also the first to use the idea of fear of the unknown in the context of scientific research. It is one of the forerunners of later 20th century novels such as Brave New World, which warn of the dire consequences of unchecked scientific progress. The novel was written as part of a game or competition between herself, her husband, the poet Byron and his friend Polidori. They were spending time in Geneva when Byron suggested they should each write a ghost story and see who could write the best. That night Shelly had a terrifying nightmare in which she saw the story of Frankenstein. Shelleys parents appear to have been hugely influential on the novel. Her father was the writer and political journalist William Godwin, who became famous with his work An Enquiry Concerning Political Justice. Godwin had revolutionary attitudes to most social institutions, and as result she had been exposed to many modern radical ideas and had been to public shows where they stimulated the muscles of dead animals or humans to produce twitching. Perhaps it was this which gave birth in her mind to the famous creation scene of Frankenstein? Her mother had died in childbirth and she herself had lost children, which features heavily in the book. The novel is told through letters from Captain Walton to his sister Margaret in what is known as a Chinese box style. Walton talks about his own story and we get to know him, then we are introduced to another character, Victor, who Walton meets in the desolate landscape of the North Pole. Victor tells his story to Walton who relates it to his sister. Victor then tells us, through Walton, of how he met his creation, the monster, and tells Walton all that the creature told him which is then written down in the letters. In this way we get a first hand account from several different characters and we get a feeling of the depth of the story as we delve deeper in to the plot and see each side of the story. Chapter 5 is the beginning of any real horror in the novel. Of course, there have been some mysterious circumstances and the bleak and desolate setting of the North Pole, but nothing to really scare the reader. But the creation of the creature is Shelley unearthing her fears about the progression of modern science. To begin with Shelley creates tension, setting the scene, saying : it was on a dreary night of November and the rain pattered dismally both of these creating a sense of unease and darkness. Furthermore, she tells us how the candle was nearly burnt out by the glimmer of the half extinguished light, I saw the dull yellow eye of the creature open, which again forms an image of a dark laboratory with flickering candle light, and creates tension, which have all become classic horror settings ever since.

Philosophy And Methods For Data Collection Management Essay This chapter looks at the research methodology and any limitations or potential problems in context to the researchers investigation of the leadership styles and their effects in influencing military divers safety perceptions, participation and acceptance of safety change within the MOD. The relevant sub-sections will specifically detail the selected strategy subscribed to in pursuit of answers to the research questions and the way in which data was gathered, analysed and utilised, and will further: Discuss the research strategy plan and considerations; Explain the reasons for the data collection methods adopted; Present the framework for data analysis and the techniques chosen to achieve the research goals. Both Bryman and Bell (2010) and Saunders, Lewis and Thornhill (2009) provide clear direction and full explanation of the layers connected with research strategy and design in terms relating to research: philosophies, approaches, strategies, methods, time horizons, technique and procedures. Figure 3-1 gives graphic representation of the Research Onion as presented by Saunders et al. (2009, p. 108). For a researcher Saunders et al. (2009, p. 108) advocates that the philosophy adopted is an important assumption about the way the world is viewed, and will underpin the research strategy and methods chosen. Saunders et al. (2009, p. 107) quantifies that The over-arching term research philosophy relates to the development of knowledge and the nature of that knowledge. The researcher view for this study is subjectivist, adopting an interpretivism philosophy combined with an inductive approach. Subjectivism is the interpretation of the meaning that individuals attach to group life occurrences; in context the researcher understands the social interaction between diving supervisors and subordinates relating to maintenance and acceptance of diving safety (Saunders et. al. 2009, p. 111). Interpretivism is the appreciation of the differences between individuals as social players; key to this will be the researcher adopting an empathetic position to enter the group world of the research subjects to fully experience and appreciate their viewpoint as far as he is able (Saunders et. al. 2009, p. 116). Inductive research approach (formulation of theory); adopting this approach allowed the researcher to gain a better understanding of people, and their attachment, in real world situations, whilst providing a greater degree of flexibility to allow changes to research emphasis as the project progressed (Saunders et. al. 2009, p. 126). The objectives for this study are set within the context of a military high risk operational diving organisation and are looking to: Identify the leadership style that best influences military divers safety perceptions, participation and acceptance of safety change. Explore the military divers concepts of safety leadership and their understanding of the defence diving safety climate. Examine the attitudes and perceptions of military divers to the organisational and technological safety changes, and the leadership of these changes. A key aspect of value to this research is the opportunity, as identified during the literature review, to bridge a gap in existing research to associate an effective leadership style, with improved safety: education, participation and acceptance of change within a dynamic and diverse high risk defence military diving environment. The people of the armed forces are the key component from leadership to subordinate, and the integration between the two will determine the success and achievement of the maritime fighting operational capability. The chosen research philosophy is proposed as effectively allowing the researcher to understand the social interaction between leadership and those they command, to gain an appreciation of the differences between individuals and the roles they perform, and to understand the values that individuals attach to safety events in the setting of a frontline operational FDG. This research is a conscious effort to assist the military command to analyse and d evelop safety leadership skills, and equally important, educate and encourage others, whilst gaining an understanding of subordinates perception and perspective of the military diving safety climate. The Research Onion (Saunders et al., 2009, p. 108) 3.2 Research Strategy In the process of framing a clear overall research plan due consideration has been given to the research project in terms of the objectives and research questions relative to the purpose of this study. The research strategy choice is led by the research questions and objectives, the amount of existing knowledge, time constraints and the resources available, supported by the researchers philosophical foundation (Saunders et. al. 2009, p. 141). This research involves serving military personnel within three operational units in the organisational structure of the FDG. The research purpose is a practical investigation with the study emphasis looking at a situation in order to explain the association between effective leadership styles and subordinate participation, perception and acceptance of safety change within a safety focused organisation. Within the context of this study, and linking the relevancy of the research methodology to the research project objectives and questions, the researcher justifies the selection of an explanatory case study strategy as the key research paradigm. A case study concentrating on the FDG as the organisation, and the three embedded FDUs within as the sub-units, will provide an empirical investigation of present military diving safety leadership within its real life operational context using multiple sources of evidence. The researcher has identified the following reasons for selecting the chosen strategy as the most appropriate: The emphasis is on studying a situation or problem in order to explain the relationships between variables (changeable military operational diving environment), Saunders et al. (2009, p. 140) explains studies that establish casual relationships between variables are termed explanatory research. Explanatory case studies centre on trying to find out explain why something happens. Biggam (2011, p. 118) cites Cohen and Manion (1995) who describe that the case study researcher typically observes the characteristics of an individual unit (single case study) or number of units (multiple case study); the purpose of such observation is to probe deeply and to analyse intensely the different phenomena that constitute the life cycle of the unit or units. Saunders et al. (2009, p. 145) supports a case study strategy by citing Robson (2002) who defines case study as a strategy for doing research which involves an empirical investigation of a particular contemporary phenomenon within its real life context using multiple sources of evidence. Saunders et al. (2009, p. 146) advocates that the adoption of a case study strategy will give a rich understanding of the context of the research, and the processes being enacted and the ability to generate answers to research questions that seek a range of different kinds of evidence. Ethical Review A University of Portsmouth Ethics Approval Form Students has been completed at Appendix 1. Ethical implications have been considered in terms of this research strategy and the key ethical issues affecting participants regarding: safety, harm, embarrassment, stress, privacy consent, confidentiality have all been carefully covered and have been fully documented within that document. The Information Sheet and Consent Form at Appendix 3 were utilised, which clearly provides information regarding participant involvement and anonymity. 3.3 Data Collection Two data collection techniques that are commonly used within research are quantitative and qualitative.
